The websites accessible at pacificsmilesdental.com.au, booking.pacificsmilesdental.com.au, pacificsmilesgroup.com.au, nibdental.com.au and booking.nibdental.com.au together with the websites of each of the practices listed in ‘Our Practices’ available at privacy.pacificsmilesgroup.com.au/practices/ (together, the Websites), are operated and maintained by Beam Dental Holdings Pty Limited (ACN 676 301 456) and its related bodies corporate (a full list of which is available here ) (together, Beam Dental Group, we, our, us).

The use of any of the Websites by a person ("you") is subject to these Terms of Use. These Terms of Use contain important information, including warranty disclaimers and limitations of liability. Your use of the Websites in any way, including, without limitation, browsing a Website, using any information contained on a Website and submitting information to Beam Dental Group using a Website, constitutes acceptance of these Terms of Use.

1. DISCLAIMER§

The content on the Websites is general and is provided for information purposes only.

These Terms of Use only apply to, and govern, your use of the Websites. If you book a dental consultation with a dentist at a Beam Dental Group clinic via a Website, the dentist is solely responsible for the healthcare services they provide to you, including compliance with standards of care, record keeping and other professional obligations, as well as compliance with privacy law. Beam Dental Group is not a party to the health professional-patient relationship between you and any dentist or other healthcare professional and is in no way involved in, or liable for, any services provided by a dentist or other healthcare professional to you.

In some cases, the content on the Websites may incorporate or summarise views, guidelines or recommendations of third parties. Such content does not necessarily reflect the views of Beam Dental Group, nor does it necessarily indicate a commitment by Beam Dental Group to a particular course of action.

Subject to the consumer guarantees provided for in consumer protection legislation (including the Australian Consumer Law set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth) (Australian Consumer Law)), Beam Dental Group does not give any express or implied warranties and makes no representations in relation to the Websites. In particular, while reasonable care is taken in its preparation, Beam Dental Group does not guarantee or warrant the accuracy, reliability, completeness or currency of the information on the Websites or its usefulness in achieving any purpose. You accept that content on the Websites may include technical inaccuracies and typographical errors. Information on the Websites should not be used without validating that information from appropriate sources and obtaining professional advice where it is prudent to do so. You should make and rely upon your own assessments and enquiries to verify the accuracy of the information provided.

In addition, subject to the consumer guarantees provided for in consumer protection legislation (including the Australian Consumer Law), Beam Dental Group does not warrant that the Websites are free from any computer viruses or other defects or that your access to the Websites will be continuous or uninterrupted. Beam Dental Group accepts no liability arising from your access to the Websites.

2. LIMITATION OF LIABILITY§

Subject to the consumer guarantees provided for in consumer protection legislation (including the Australian Consumer Law), Beam Dental Group:

• accepts no liability arising from the content on the Websites, or on websites linked from the Websites, being incorrect, incomplete or misleading; and
• will not be liable for any loss, damage, cost or expense incurred or arising by reason of any person relying on the content of the Websites.

3. CONSUMER GUARANTEES§

The Websites come with non-excludable guarantees that cannot be excluded under the Australian Consumer Law. If Beam Dental Group breaches any of these non-excludable warranties or guarantees, you are entitled, at your option, to a refund or the re-supply of the services, and to compensation for any other reasonably foreseeable loss.

4. INTELLECTUAL PROPERTY§

The content on the Websites, including but not limited to text, graphics, logos, photographs and images, is owned by or licensed to Beam Dental Group and protected by Australian and international copyright laws. The compilation of all such content is the exclusive property of Beam Dental Group and protected by Australian and international copyright laws. The Websites may also feature the names, logos or other trademarks of third partieswhich remain the property of their respective owners and are used with permission or in accordance with applicable law. Nothing in these Terms of Use is intended to imply any ownership by, or affiliation with, Beam Dental Group of any such third party trademarks.

All related graphics, photographs, logos, and product and service names owned by Beam Dental Group are trademarks (both registered and unregistered) of Beam Dental Group. These trademarks, logos and other proprietary graphics may not be used in connection with any other product or service without Beam Dental Group' express prior written consent. This does not apply to any third party trademarks, logos or proprietary graphics that may appear on the Websites, which remain subject to the rights of their respective owners.

Using the Websites does not give you any rights, title, interest or ownership in any intellectual property rights (including copyright) nor does it give you any proprietary rights to the content on the Websites or any trademarks, logos or other proprietary graphics of Beam Dental Group.

5. LICENCE AND SITE ACCESS§

Subject to your acceptance of these Terms of Use, Beam Dental Group authorises you to view, download and/or print a small number of copies of the content on the Websites for your personal, non-commercial use, provided you retain all copyright and other proprietary notices on all such copies. Otherwise, no content on the Website may be reproduced, modified, republished, transmitted, displayed, performed, or distributed in any way without the express prior written consent of Beam Dental Group or as permitted by law. You may not modify, sell, assign, or transfer the content of the Websites or reproduce, display, distribute or otherwise use the content of the Websites in any way for any public or commercial purpose or otherwise except as expressly permitted in these Terms of Use. Content on the Websites is subject to change without notice at the discretion of Beam Dental Group.

You are granted a limited, revocable and non-exclusive right to create a hyperlink to the home page of each Website so long as the link does not portray Beam Dental Group or its functions and activities in a false, misleading, derogatory or otherwise offensive manner. If requested by Beam Dental Group, you must remove any hyperlink to any Website contained on your website.

6. THIRD PARTY WEBSITES AND LOGOS§

Beam Dental Group may include links on the Website to websites owned by other parties. Beam Dental Group is not responsible for the material contained on these websites or the availability of these websites. Beam Dental Group does not endorse and is not responsible or liable for any content, including advertising or products offered on these websites, nor is Beam Dental Group responsible for any damage, offence or loss caused as the result of visiting these websites. Beam Dental Group recommends that before you visit any website you check that your device is running up-to-date virus checking software.

Beam Dental Group may also include logos, graphics and images on the Websites that are the property of other parties. Beam Dental Group does not endorse and is not responsible for any goods or services offered by such other parties, nor is Beam Dental Group responsible for any damage, offence or loss caused as a result of your use of any goods or services offered by such other parties.

When you use Beam Dental Group's social media pages, you are using an external website and are bound by the terms and conditions of use of that website. We encourage you to review the terms and conditions of the relevant social media websites. To the fullest extent permitted by law, Beam Dental Group accepts no responsibility for the accuracy or completeness of views or information posted by third parties to Beam Dental Group's social media pages.

7. APPOINTMENTS AND SUBMISSIONS§

If you use a Website to make an appointment booking, you must:

• provide true, accurate and complete information; and
• ensure all personal details entered are your own or you must have the authority or consent of the individual whose details you provide.

Beam Dental Group may refuse, cancel or block any appointment booking that it reasonably believes to be fraudulent, inappropriate, duplicative or otherwise in breach of these Terms of Use. Subject to the consumer guarantees provided for in consumer protection legislation (including the Australian Consumer Law), Beam Dental Group is not liable for any loss of data, booking or information resulting from technical failure, system outage or cancellation. If an appointment is cancelled by us, we will attempt to contact you and reschedule, but no compensation or other remedy will be provided.

Any material you send to Beam Dental Group on or via a Website will be deemed to be non-proprietary, unless it is indicated otherwise. This includes any data, questions, comments, suggestions, ideas or other information. You warrant that any material you send to Beam Dental Group on or via a Website does not infringe any third party intellectual property rights. Beam Dental Group may use any material provided by you to Beam Dental Group on or via a Website which has not been indicated as being proprietary for any purpose without compensation to you.

8. PRIVACY§

Your personal (including sensitive) information will be collected by Beam Dental Group if you choose to book an appointment, provide information to Beam Dental Group through a Website or contact Beam Dental Group on or via a Website. Beam Dental Group's Privacy Policy, which can be accessed at https://privacy.pacificsmilesgroup.com.au/, explains how Beam Dental Group generally handles your personal (including sensitive) information. The Privacy Policy also includes information about how you can:

• seek to access and/or correct your personal information that Beam Dental Group holds about you; and
• submit a privacy query or complaint to Beam Dental Group and how Beam Dental Group will deal with your complaint.

By using any Website, you agree that Beam Dental Group can use your personal (including sensitive) information in accordance with its Privacy Policy.

9. COOKIES AND LOCATION DATA§

Beam Dental Group uses cookies and similar technologies to understand how you use the Websites and social media platforms. Cookies allow Beam Dental Group to collect information about your device, which may include your IP address (a number assigned to your computer when you register with an Internet Service Provider), type of browser, operating system, domain name, and the details of any website which has referred you to this Website.  The information collected does not usually directly identify you. Beam Dental Group uses this information to track which parts of the Websites (including links to other websites) are being visited by you, enhance your user experience and support navigation.

Beam Dental Group uses two general types of cookies:

• persistent cookies: these will be stored by your browser and remain valid until their set expiry date (unless deleted earlier by you); and

Beam Dental Group only uses cookies if the privacy settings you have chosen on your device allow it to accept our cookies. You can also choose not to allow some types of cookies. However, if you disable cookies you may not be able to access all parts of the Websites.

Depending on your device settings, location services may activate automatically when you make a booking, search for or locate a Beam Dental Group practice on a Website or when you select the "use my location" feature on a Website. Beam Dental Group uses your device's location at the time of the session to identify your nearest Beam Dental Group practice. We do not collect or retain precise location data beyond your session. However, we do collect information about the Beam Dental Group location you click on or select when making a booking and this information is recorded at the time of booking.

We also collect anonymised, non-identifiable location data to understand general demand for our practices. This information relates only to the Beam Dental Group location interacted with and does not include your exact device location.

Location services used on the Websites are provided by Google. Your device manufacturer may also collect or process location information depending on the terms applicable to your device.

10. GENERAL§

These Terms of Use are effective from August 2026. Beam Dental Group may vary these Terms of Use at any time by publishing a revised version of the Terms of Use on the Websites.

The law applicable to the Websites is the law of the State of New South Wales.
