Patient Portal Terms of Use

This portal accessible via eform.pacificsmiles.com.au, eforms.nibdental.com.au, eforms.hbfdental.com.au and centaurportal.com] (Patient Portal) is operated and maintained by Centaur Software Development Co Pty Ltd ACN 057 620 390 (Centaur Software), who is a service provider of Beam Dental Holdings Pty Limited (ACN 676 301 456) and its related bodies corporate (a full list of which is available here. (Beam Dental Group, we, our, us).

Beam Dental Group facilitates access to the Patient Portal to allow patients to manage bookings with registered dentists at Beam Dental Group clinics (Beam Dental Group Dentists) and to provide associated information to Beam Dental Group and Beam Dental Group Dentists (including via patient forms).

The use of the Patient Portal by a person ("you") is subject to these Terms of Use. These Terms of Use contain important information, including warranty disclaimers and limitations of liability. Your use of the Patient Portal in any way, including, without limitation, submitting information to Beam Dental Group using the Patient Portal, constitutes continued acceptance of these Terms of Use.

DISCLAIMER§

Unless information is provided directly to you by a Beam Dental Group Dentist, the content on the Patient Portal is general and is provided for information purposes only.

These Terms of Use only apply to, and govern, your use of the Patient Portal. If you consult with a Beam Dental Group Dentist, the Beam Dental Group Dentist is solely responsible for the healthcare services they provide to you, including compliance with standards of care, record keeping and other professional obligations, as well as compliance with privacy law. Beam Dental Group is not a party to the health professional-patient relationship between you and any dentist or other healthcare professional and is in no way involved in, or liable for, any services provided by a dentist or other healthcare professional to you.

In some cases, the content on the Patient Portal may incorporate or summarise views, guidelines or recommendations of third parties. Such content does not necessarily reflect the views of Beam Dental Group, nor does it necessarily indicate a commitment by Beam Dental Group to a particular course of action.

Subject to the consumer guarantees provided for in consumer protection legislation (including the Australian Consumer Law set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth) (Australian Consumer Law)), Beam Dental Group does not give any express or implied warranties and makes no representations in relation to the Patient Portal. In particular, while reasonable care is taken in its preparation, Beam Dental Group does not guarantee or warrant the accuracy, reliability, completeness or currency of the information on the Patient Portal or its usefulness in achieving any purpose. You accept that content on the Patient Portal may include technical inaccuracies and typographical errors. Information on the Patient Portal should not be used without validating that information from appropriate sources and obtaining professional advice where it is prudent to do so. You should make and rely upon your own assessments and enquiries to verify the accuracy of the information provided.

In addition, subject to consumer guarantees provided for in consumer protection legislation (including the Australian Consumer Law), Beam Dental Group does not warrant that the Patient Portal is free of any computer viruses or other defects or that access to the Patient Portal will be continuous or uninterrupted. Beam Dental Group accepts no liability arising from your access to the Patient Portal.

LIMITATION OF LIABILITY§

Subject to the consumer guarantees provided for in consumer protection legislation (including the Australian Consumer Law), Beam Dental Group:

• accepts no liability arising from the content on the Patient Portal, or on websites linked from the Patient Portal, being incorrect, incomplete or misleading; and
• will not be liable for any loss, damage, cost or expense incurred or arising by reason of any person relying on the content of the Patient Portal.

CONSUMER GUARANTEES§

The Patient Portal comes with non-excludable guarantees that cannot be excluded under the Australian Consumer Law. If Beam Dental Group breaches any of these non-excludable warranties or guarantees, you are entitled, at your option, to a refund or the re-supply of the services, and to compensation for any other reasonably foreseeable loss.

USE OF THE PATIENT PORTAL§

ELIGIBILITY FOR A PERSONAL ACCOUNT§

Creation of a person account (Personal Account) is required to access and use the Patient Portal and to complete patient forms needed for an appointment with a Beam Dental Group Dentist.

To be eligible to create a Personal Account and access that Personal Account, you must be (at a minimum):

• aged 18 years or over;
• residing in Australia (ie. have a current Australian address); and
• planning to access the goods and services provided by Beam Dental Group within Australia.

Beam Dental Group has the sole right to determine your eligibility to create or maintain a Personal Account, including the right to suspend or cancel an account where eligibility requirements are not met.

You must provide true, accurate and complete information when registering for and using your Personal Account and must ensure that such information is current and up to date at all times. All personal details entered must be your own or you must have the authority or consent of the individual whose details you provide.

RESPONSIBILITY FOR YOUR PERSONAL ACCOUNT§

If you create a Personal Account, you are solely responsible for maintaining the confidentiality and security of your username and password and must not share these details with any other person. We may, from time to time, require you to re-authenticate, reset your credentials or comply with other security measures we consider are necessary.

Beam Dental Group is entitled to assume that any activity undertaken using your security credentials has been carried out by you. You must notify Beam Dental Group immediately if you suspect any unauthorised access or misuse of your Personal Account, including any unauthorised access to the Patient Portal or loss, theft or unauthorised disclosure of your username or password.

APPROPRIATE USE OF THE PATIENT PORTAL§

You may only use the Patient Portal for purposes set out in these Terms of Use. You must not use, or attempt to use, the Patient Portal:

• for any unlawful purpose or in a manner that breaches any law or regulation;
• to solicit others to engage in unlawful conduct;
• for any commercial purpose, unless authorised in writing by Beam Dental Group;
• to submit or upload false or misleading information or information that may be false or misleading;
• to corrupt, damage or interfere with the Patient Portal, any booking functionality provided by or on behalf of Beam Dental Group or any third party data, systems, software, hardware or website;
• to harass, abuse, insult, harm, defame, intimidate or discriminate against any person;
• to upload or transmit any offensive, defamatory, fraudulent or otherwise unlawful material;
• to adversely affect the reputation of Beam Dental Group or any Beam Dental Group Dentist; or
• to cause nuisance, annoyance or inconvenience to Beam Dental Group, any Beam Dental Group Dentist or any third party.

Beam Dental Group may refuse, cancel or block any appointment booking that it reasonably believes to be fraudulent, inappropriate, duplicative or otherwise in breach of these Terms of Use.

Beam Dental Group may terminate or suspend your access to the Patient Portal, including your Personal Account, if we reasonably believe you have breached these Terms of Use. Without limiting our rights, we may, at our sole discretion and without notice:

• block or restrict your access to the Patient Portal;
• limit or disable your Personal Account;
• remove any material submitted by you to the Patient Portal; or
• refuse to provide any goods or services offered by, or on behalf, of Beam Dental Group or any Beam Dental Group Dentist.

Subject to the consumer guarantees provided for in consumer protection legislation (including the Australian Consumer Law), Beam Dental Group is not liable for any loss of data, booking or information resulting from technical failure, system outage or cancellation. If an appointment is cancelled by us, we will attempt to contact you and reschedule, but no compensation or other remedy will be provided.

CLOSING YOUR PERSONAL ACCOUNT§

INTELLECTUAL PROPERTY§

The content on the Patient Portal, including but not limited to text, graphics, logos, photographs and images, is owned by or licensed to Beam Dental Group and protected by Australian and international copyright laws. The compilation of all such content is the exclusive property of Beam Dental Group and protected by Australian and international copyright laws.

All related graphics, photographs, logos, and product and service names are trademarks (both registered and unregistered) of Beam Dental Group. These trademarks, logos and other proprietary graphics may not be used in connection with any other product or service without Beam Dental Group's express prior written consent.

Using the Patient Portal does not give you any rights, title, interest or ownership in any intellectual property rights (including copyright) nor does it give you any proprietary rights to the content on the Patient Portal or any trademarks, logos or other proprietary graphics of Beam Dental Group.

LICENCE AND PATIENT PORTAL ACCESS§

Subject to your acceptance of these Terms of Use, Beam Dental Group authorises you to view, download and/or print a small number of copies of the content on the Patient Portal for your personal, non-commercial use, provided you retain all copyright and other proprietary notices on all such copies. Otherwise, no content on the Patient Portal may be reproduced, modified, republished, transmitted, displayed, performed or distributed in any way without the express prior written consent of Beam Dental Group or as permitted by law. You may not modify, sell, assign or transfer the content of the Patient Portal in any way for any public or commercial purposes or otherwise except as expressly permitted in these Terms of Use.

THIRD PARTY CONTENT§

PATIENT PORTAL HOSTED BY THIRD PARTY§

• The Patient Portal is hosted and facilitated by Centaur Software. These Terms of Use, as well as any additional terms issued by Centaur Software from time to time, govern your access to and use of the Patient Portal.

THIRD PARTY WEBSITES AND LOGOS§

Beam Dental Group may include links on the Patient Portal to websites owned by other parties. Beam Dental Group is not responsible for the material contained on these websites or the availability of these websites. Beam Dental Group does not endorse and is not responsible or liable for any content, including advertising or products offered on these websites, nor is Beam Dental Group responsible for any damage, offence or loss caused as a result of visiting these websites. Beam Dental Group recommends that before you visit any website you check that your device is running up-to-date virus checking software.

Beam Dental Group may also include logos, graphics and images on the Patient Portal that are the property of other parties. Beam Dental Group does not endorse and is not responsible for any goods or services offered by such other parties, nor is Beam Dental Group responsible for any damage, offence or loss caused as a result of your use of any goods or services offered by such other parties.

When you access Beam Dental Group' website or social media pages, you are using an external website and are bound by the terms and conditions of use of that website. We encourage you to review the terms and conditions of any site you visit.

COOKIES§

Beam Dental Group does not use cookies or tracking technologies in the Patient Portal. Centaur Software may use cookies or similar technologies in connection with the Patient Portal. GENERAL§

These Terms of Use are effective from August 2026

Beam Dental Group may update, vary or replace any part of these Terms of Use at any time by publishing a revised version on the Patient Portal. Beam Dental Group will also post a notice within the Patient Portal when modifications are made. Any new features or tools added to the Patient Portal will automatically be governed by the updated Terms of Use. The most current version of the Terms of Use will always be available on this page, and it is your responsibility to review it periodically. Changes will not apply retroactively and will take effect no earlier than [insert] days after they are posted, unless they relate to new Patient Portal features or are required for legal or regulatory reasons, in which case they will take effect immediately. If you do not agree to the modified Terms of Use, you should discontinue your use of the Patient Portal.

The law applicable to the Patient Portal is the law of the State of New South Wales.
